1. Agreement

These Terms of Service ("Terms") govern your access to and use of the Chegatta website and software-as-a-service platform (the "Service"). By creating an account or using the Service, you agree to be bound by these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization.

2. Accounts

You must provide accurate and complete information when creating an account and keep it up to date. You are responsible for safeguarding your login credentials and for all activity under your account. Notify us immediately of any unauthorized use at security@chegatta.com .

3. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of applicable labor or privacy laws.
  • Attempt to access, probe, or interfere with systems, data, or accounts other than your own.
  • Reverse engineer, decompile, or attempt to extract the source code of the Service.
  • Resell, sublicense, or transfer access to the Service without our written consent.
  • Upload malicious code or content that infringes the rights of others.

4. Attendance Data

The Service processes attendance data on your behalf. You retain full ownership of your data and are responsible for its accuracy and for obtaining any necessary consent from your employees or contractors. We act as a data processor with respect to that data and process it only to provide the Service, as described in our Privacy Policy .

5. Subscriptions and Billing

Paid plans are billed in advance on the frequency you select. Fees are non-refundable except as required by law. You can change or cancel your subscription at any time; access continues until the end of the paid period. We may change prices with reasonable advance notice, and the new price applies at the next billing cycle.

6. Free Trial

We offer a free trial period for evaluation. Trial accounts may be limited in features or usage. At the end of the trial, access ends unless you upgrade to a paid plan. We may modify or discontinue trial offers at any time.

7. Availability and Support

We aim to keep the Service available at all times, but we do not guarantee uninterrupted availability. The Service is provided "as is" without warranties of any kind, express or implied, including merchantability and fitness for a particular purpose. You are responsible for maintaining backups of data you rely upon.

8. Intellectual Property

The Service, including its software, design, logos, and content, is owned by Chegatta and protected by intellectual property laws. Except for the rights expressly granted in these Terms, we retain all rights, title, and interest in the Service. We welcome feedback, but you grant us a perpetual, royalty-free license to use feedback to improve the Service.

9. Limitation of Liability

To the maximum extent permitted by law, Chegatta shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising from or related to your use of the Service. Our total aggregate liability shall not exceed the amounts you paid to us in the twelve months preceding the claim.

10. Termination

You may terminate your account at any time. We may suspend or terminate access for violation of these Terms, illegal activity, or non-payment. Upon termination, you can export your data during a reasonable wind-down period, after which we delete it in accordance with our Privacy Policy .

11. Changes to These Terms

We may update these Terms from time to time. Material changes will be posted on this page with an updated "Last updated" date and, where practical, notified by email. Continued use of the Service after changes take effect constitutes acceptance.

12. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-law provisions. Any disputes will be resolved in the state or federal courts located in Delaware.
